FIRST PART

Purpose, Scope, Basis and Definitions

Goal

ARTICLE 1 – (1) The purpose of this Regulation; To ensure that elevators used for the transport of people and / or cargoes are used in such a way that the environment is not threatened by health and safety of people and the living after they are taken into service; Operating, maintenance and annual inspections.

Scope

ARTICLE 2 – (1) This Regulation covers elevators mounted within the scope of the Elevator Regulation (95/16 / EC) published in the Official Gazette dated 31/1/2007 and numbered 26420 and lifts which are already installed and still active before the same Regulation enters into force .

Rest

ARTICLE 3 – (1) This Regulation shall be amended to the provisions of Article 2 and 33 of the Act on the Organization and Duties of the Ministry of Industry and Commerce dated 8/1/1985 and numbered 3143 and Article 19 of the Act on the Protection of Consumers dated 23/2/1995 and numbered 4077 .

Definitions

ARTICLE 4 – (1) In this Regulation;

A) Elevator: Serves at certain levels, has a fixed and moving cabinet that moves along rails at an angle of more than 15 degrees to the horizontal, If a person is allowed to enter the cabin without difficulty and is equipped with controls located within the cabin or at the access point of the person in the cabin,

B) Lift installer: Any person who is responsible for the supply of elevators to the design, manufacture, installation and market, accompanied by the ascent CE marking and regulating EC declaration of conformity,

C) EC declaration of conformity: The certificate of conformity with the provisions of the Elevator Directive (95/16 / EC) of the elevator the elevator installer supplies to the market,

Ç) Ministry: Ministry of Industry and Trade,

D) Maintenance: All operations, as designed after the elevator has been put into service, for the duration of its lifetime, to ensure continuity of its functions and components and safety requirements,

E) Building Responsibility: The owner or owner or owner of the building, or any real or legal person authorized by them, who is responsible for regularly maintaining, repairing and inspecting the yacht in order to ensure safe operation of the elevator,

F) Rescue work: The rescue work shall be carried out in accordance with the rescue instructions contained in the technical file of the elevator, starting with the receipt of information that the human /

G) Competent Engineer: Electrical / Electronics and Mechanical Engineers who have been certified for the elevators by the Chamber of Electrical Engineers and the Chamber of Mechanical Engineers affiliated to the Turkish Engineers and Architects Chambers of the Union with respect to project, installation, maintenance, alterations, standards and legislation,

Ğ) Authorized service: To carry out the maintenance services of elevator installer, elevator; The real or legal person who has the TSE Service Qualification Certificate which he has been authorized by the contract made before the notary public,

H) Annual control: means the control to be carried out by the building manager at least once a year, two years after service, in order to determine that the elevator is operating properly and securely and operationally.

ARTICLE 5 – (1) Procedures for the compliance of the elevator to the building where the building is installed, for the buildings outside the municipality or municipal boundaries, by the establishments authorized by the Governorship or related laws to give building permission, the Construction Law No. 3194 dated 3/5/1985 and other related laws And pursuant to the applicable legislation under these laws.

(2) In order to register the elevators falling within the scope of this Regulation, the elevators to be taken into operation shall be registered with the institutions and establishments which are authorized by the governorship for buildings outside the municipality or municipal boundaries, or by giving building permits within the framework of the related laws. The elevator installer registers the elevator by referring to the establishments mentioned above together with the EC Compliance Statement.

3) For buildings outside the municipalities or municipal boundaries, the registrations made by the governorates or institutions and institutions authorized by the relevant laws within the framework of the relevant legislation shall be notified to the Provincial Directorate of Industry and Commerce on the occasion of which the elevator is located within six months periods.

PART THREE

Maintenance of Elevators, Scope of Maintenance and Other Related Issues

Apartment and Site Lift Maintenance

ARTICLE 6 – (1) During the use of elevators within the scope of this Regulation, in order to ensure the safety of life and property under continuous control,

Scope of maintenance

ARTICLE 7 – (1) In order to ensure the safety of life and property; Maintenance and operation of the elevator and all of its components.

A) Maintenance;

1) Lubrication and cleaning,

2) Controls,

3) Rescue work,

4) Adjustment processes,

5) repair or replacement of components that do not affect the characteristics of the elevator, which may occur due to wear or tear.

B) Maintenance;

1) Even if the characteristics of the new component are the same as the original, it is necessary to change the main component or safety assembly such as the machine, lift cabin, door, control panel, guide rail,

2) to change the location of the elevator,

3) The speed of the elevator, the load it can carry. Modernization, including the change of any character,

4) Rescue work carried out by the fire brigade,

5) To clean the outer parts of the elevator cavity (well)

6) Cleaning of the inside of the elevator cab, does not cover.

Other aspects of care

ARTICLE 8 – (1) Other aspects related to care are stated below.

A) The elevator maintenance book to be provided by the maintenance company is examined by the officials in the controls to be performed. This notebook is kept permanently in the machine room or building responsibly if it is a lift. After each maintenance, all operations related to elevator maintenance are processed in the elevator maintenance book. A copy of the records to be processed in the care book will also be kept by the care provider.

B) Maintenance companies shall keep the elevators in accordance with this Regulation and inform the building responsibilities in case of risk of the elevator due to safety of life and property. Once informed, the building supervisor will ensure that the elevator is made available. In case the non-compliance is not remedied despite the written notice of the maintenance company, responsibility will be with the building responsibility.

C) After undertaking the maintenance contract, the firm shall prepare a detailed condition report for the elevator and give it to the building responsible for signing the maintenance contract.

Ç) The maintenance company shall provide any necessary information on the condition of the elevator that it cares for, if requested.

D) The maintenance company must provide training on rescue work in emergency situations to the number of persons to be determined by the building supervisor considering the number of elevators, not less than two people. This training will be recorded with a record. Instructions including rescue operations will also be kept where they can easily see the rescue operation. The building supervisor will ensure that new staff are trained if the trainees change.

E) Any amendment of the lift which is not included in the sub-paragraphs (1), (2), (3) of subheading (b) of Article 7 of this Regulation and which is not considered as maintenance work shall be carried out by the installer.

F) When elevator maintenance is carried out, the applicable maintenance standards must be taken into consideration.

G) Maintenance contracts can not include any items contrary to this Regulation.

SECTION FOUR

Building Supervisor and Annual Control

Building responsible

ARTICLE 9 – (1) Building responsibilities; Maintenance of the elevator at least once a month in order to ensure safe operation of the elevator in accordance with the provisions of this Regulation and full maintenance of the life and property of the users and the first annual control of the elevator to prevent any danger that may arise from external disturbances After the next two years, at least once a year.

Annual check

ARTICLE 10 – (1) For the buildings outside the municipality or municipal boundaries to which the building is connected, each establishment is inspected at least once a year, two years after the elevator is served, by the institutions and organizations authorized by the governorship or related laws and regulations to give building permits . However, the municipalities or the governor’s office that do not have enough Electric / Electronic and Mechanical Engineers in its staff, or the institutions and organizations that are authorized to issue building permits within the framework of the related laws, may make the annual control work to Authorized Engineers who are not involved in the construction of that elevator. A report shall be issued by these engineers in the form of at least three copies indicating that there is no obstacle to the operation of the plant due to safety of life and property. A copy of the prepared report shall be kept in the municipality or in the governorship or in the institutions and organizations authorized to issue building permits within the framework of the related laws, in the responsibility of the company and the building which maintains it. The responsibility for the issuance of this report belongs to the building where the elevator is located.

(2) The annual inspection will be carried out under the supervision of the firm that undertakes maintenance of the elevator.

PART FIVE

Miscellaneous and Final Provisions

Provisions to be applied in contraventions

ARTICLE 11 – (1) Regarding those who act contrary to the provisions related to service of this Regulation; The Law on the Protection of the Consumer No. 4077 of 23/2/1995, the general provisions shall apply in cases where the parties are excluded from the scope of this Law.

Provisions removed from enforcement

ARTICLE 12- (1) Articles 14 to 26 of the Elevator Regulation (95/16 / EC) published in the Official Gazette dated 15/2/2003 and numbered 25021 have been abolished.

Force

ARTICLE 13 – (1) This Regulation shall enter into force six months after the date of its publication.

Executive

ARTICLE 14 – (1) The provisions of this Regulation shall be executed by the Minister of Industry and Trade.
